DMCA Policy
MemoVPS Store respects intellectual property rights and expects customers to use our VPS hosting services lawfully. This policy explains how copyright owners can report alleged infringement and how affected customers may respond.
1. Scope of This Policy
This DMCA Policy applies to copyright complaints involving services provided by MemoVPS Store through www.memovps.site. Our VPS hosting services provide computing resources that customers may use to operate websites, applications, and other permitted workloads.
This policy addresses allegations that copyrighted material is stored, displayed, distributed, or otherwise made available through a customer’s VPS or associated service. It does not replace applicable copyright law or other legal procedures.
2. Reporting Alleged Copyright Infringement
If you are a copyright owner or an authorized representative and believe that material associated with a MemoVPS Store customer infringes your copyright, you may submit a written notice.
Please provide sufficient information for us to identify the copyrighted work, locate the allegedly infringing material, and contact you if clarification is required.
General copyright inquiries may be directed to [email protected]. Formal DMCA notices should be submitted to the designated agent using the contact details published in this policy once that agent has been properly designated.
3. Information Required in a DMCA Notice
To help us review a copyright complaint, include the following information to the extent required by applicable law:
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Copyrighted work: Identification of the work claimed to have been infringed, or a representative list of works where appropriate.
- Reported material: The URL, IP address, hostname, or other sufficiently specific information that helps locate the allegedly infringing material.
- Contact information: Your name and sufficient contact details, such as a mailing address, telephone number, and email address where available.
- Good-faith statement: A statement that you believe in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy and authority statement: A statement that the information is accurate and, under penalty of perjury where required by applicable law, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.
Incomplete notices may delay our review. Where applicable law requires additional information or reasonable efforts to obtain missing information, we will follow the relevant requirements.
4. Review and Response Process
After receiving a copyright complaint, MemoVPS Store may:
- Review the notice and assess whether it identifies the material sufficiently.
- Request additional information when necessary and appropriate.
- Notify the affected customer, where appropriate or legally required.
- Remove or disable access to identified material when required by applicable law or otherwise justified under our policies.
- Suspend or terminate services in accordance with our Terms of Service and applicable law.
We aim to review credible complaints promptly. The time required for review depends on the information provided, the nature of the allegation, and any applicable legal requirements. We do not guarantee a particular resolution time.
5. Counter-Notification
If material associated with your VPS has been removed or access has been disabled because of a copyright complaint, and you believe the action resulted from a mistake or misidentification, you may submit a written counter-notification where permitted by applicable law.
A counter-notification may need to include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and its previous location.
- A statement, made under penalty of perjury where required, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.
- Your name, address, and telephone number.
- The jurisdictional consent and service-of-process statements required by applicable law.
Submit counter-notifications through the designated agent's published contact details. We may forward a valid counter-notification to the original complainant and follow the applicable legal procedure before restoring material or access. Restoration is not automatic and may be affected by a court action or other applicable legal requirements.
6. Repeat Copyright Infringement
MemoVPS Store does not permit repeated copyright infringement through its services. Where appropriate and consistent with applicable law, we may issue warnings, restrict access, suspend services, or terminate accounts associated with repeat infringement.
We assess cases based on the available information, the circumstances of the complaint, prior substantiated incidents, and applicable contractual and legal requirements.
7. Customer Responsibilities
Customers must ensure that they have the necessary rights, licenses, and permissions for software, websites, media, downloads, and other content they use or distribute through their VPS.
Customers must not use MemoVPS Store services to host or distribute copyrighted material unlawfully. Customers should respond promptly to legitimate complaints and take appropriate action when they become aware of unauthorized material.
Customers remain responsible for their content and activities, subject to applicable law and the terms governing their service.
8. Misrepresentation and Abuse of the Process
Copyright notices and counter-notifications should be accurate and submitted in good faith. Knowingly making material misrepresentations in a copyright notice or counter-notification may result in legal consequences under applicable law.
We may take appropriate steps when there is credible evidence that the reporting or counter-notification process is being abused.
9. Privacy and Disclosure
Information submitted in a copyright complaint or counter-notification may be used to investigate the matter, communicate with the parties involved, comply with legal obligations, and protect our services.
Where appropriate or legally required, relevant information may be shared with the affected customer, the complainant, legal representatives, or competent authorities. For further information, please review our Privacy Policy.
10. No Waiver of Legal Rights
Nothing in this policy limits rights or remedies available under applicable law. This policy does not guarantee that every complaint will result in removal, suspension, or termination, and it does not determine the legal merits of a copyright dispute.
MemoVPS Store may update this policy when our procedures, services, or applicable legal requirements change.
